Terms of service
Terms of Service
1. About these terms
These Terms of Service apply to purchases made through the Manor Models website. By placing an order, you agree to these terms.
Please read them carefully before ordering. These terms do not affect your statutory rights as a consumer.
2. About Manor Models
This website is operated by Manor Models.
Our contact details are available on the Contact page of this website. Any formal business address, company registration number or VAT registration number shown on the website forms part of these terms.
3. Products
We make every reasonable effort to ensure that product descriptions, photographs, specifications and prices are accurate.
Colours and product appearance may vary slightly depending on your screen, lighting and the age or condition of an item. Measurements and dimensions are approximate unless stated otherwise.
Some products may contain small parts and may not be suitable for children. Customers are responsible for checking that a product is appropriate for its intended use and age group.
4. Product availability
All orders are subject to availability.
Adding an item to your basket does not reserve it. If an item becomes unavailable after you place an order, we will contact you and offer an alternative where appropriate or issue a refund.
We may limit the quantity of certain products available to an individual customer.
5. Prices
All prices are shown in pounds sterling unless otherwise stated.
Applicable taxes will be included where required. Delivery charges and any other applicable costs will be displayed before you complete checkout.
We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted.
If a product has been listed at an obviously incorrect price, we may cancel the order and refund any payment made.
6. Placing an order
You are responsible for ensuring that the information supplied when placing an order is complete and accurate.
After placing an order, you should receive an order confirmation email. This acknowledges that we have received your order but does not necessarily mean that it has been accepted.
A binding contract is formed when we confirm that your order has been accepted or dispatched.
We reserve the right to refuse or cancel an order where:
- The product is unavailable
- Payment cannot be authorised
- The delivery address is incomplete or unsuitable
- An obvious pricing or product-description error has occurred
- We reasonably suspect fraudulent or unauthorised activity
Where payment has already been taken for a cancelled order, a refund will be issued.
7. Payment
Payment must be made using one of the methods offered at checkout.
You confirm that you are authorised to use the payment method supplied. Orders will not normally be dispatched until payment has been successfully received.
Payments may be processed securely by third-party payment providers. We do not retain complete payment-card details.
8. Delivery
Orders are delivered in accordance with our separate Shipping Policy.
Delivery dates and times are estimates unless a guaranteed service has been expressly agreed. We are not responsible for delays caused by events outside our reasonable control, although we will take reasonable steps to assist in resolving delivery problems.
You are responsible for supplying a complete and accurate delivery address.
Unless another timeframe has been agreed, UK consumer orders should be delivered without undue delay and within 30 days of the contract being made.
9. Ownership and risk
The goods remain our property until full payment has been received.
Responsibility for the goods passes to you when they are delivered to you, or to another person you have nominated to receive them.
Where you separately arrange your own carrier, responsibility may pass when the goods are handed to that carrier.
10. Cancelling an order
Please contact us as quickly as possible if you wish to cancel an order before dispatch.
We cannot guarantee that an order can be stopped once it has entered the dispatch process.
For most goods purchased online, consumers have the right to tell us that they wish to cancel within 14 days of receiving them. They then normally have a further 14 days in which to return the goods. Some legal exceptions apply.
Further information is provided in our Returns Policy.
11. Returns and refunds
Returns are handled in accordance with our separate Returns Policy.
Goods returned because the customer has changed their mind must be handled with reasonable care. We may make a reasonable deduction from a refund where handling beyond what would be permitted in a shop has reduced the value of the goods.
Unless goods are faulty, damaged, incorrect or not as described, the customer is responsible for return postage.
Nothing in these terms limits your legal rights relating to faulty, misdescribed or unsuitable goods.
12. Faulty, damaged or incorrect goods
Goods must be of satisfactory quality, fit for their intended purpose and as described.
Please contact us promptly if goods arrive faulty, damaged, incomplete or different from those ordered. We may request photographs and may require the item and its packaging to be retained while the issue is investigated.
Depending on the circumstances and your legal rights, we may offer a repair, replacement, price reduction or refund. UK consumer rights cannot be excluded by these terms.
13. Model parts and compatibility
Customers are responsible for checking product references, dimensions and compatibility before ordering.
Where compatibility information is supplied, it is based on the information reasonably available to us. Please contact us before ordering when you are uncertain whether a part is suitable for a particular model.
Our responsibility for incorrectly supplied goods is not affected by this section.
14. Acceptable use of the website
You must not:
- Use the website for unlawful or fraudulent purposes
- Attempt to interfere with its operation or security
- Introduce malicious software
- Copy, scrape or commercially exploit website content without permission
- Place false, speculative or unauthorised orders
We may restrict or withdraw access where these terms are breached.
15. Intellectual property
The website and its content, including text, branding, graphics, photographs and layout, belong to Manor Models or their respective licensors unless otherwise stated.
Content may not be reproduced, distributed or used commercially without prior written permission.
Product names, manufacturers’ names and trademarks remain the property of their respective owners. Their use is for identification and compatibility purposes and does not necessarily indicate affiliation or endorsement.
16. Website availability
We aim to keep the website available and accurate but cannot guarantee uninterrupted or error-free access.
We may suspend, withdraw or amend any part of the website for maintenance, security or operational reasons.
17. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of your statutory consumer rights
- Any other liability that cannot legally be excluded
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Where you purchase as a consumer, we are not responsible for business losses, including loss of profit, revenue, opportunity or data.
18. Events outside our control
We will not be responsible for delay or failure caused by circumstances outside our reasonable control, such as postal disruption, transport failure, severe weather, industrial action, supplier failure, system outages or government restrictions.
We will take reasonable steps to reduce the effect of such events and will contact affected customers where appropriate.
19. Personal information
Personal information is handled in accordance with our Privacy Policy.
Information may be shared with payment processors, delivery providers and other service providers where necessary to process and fulfil an order.
20. Changes to these terms
We may update these Terms of Service occasionally.
The terms in force when an order is placed will apply to that order. The latest version will be published on this website.
21. Severability
If any provision of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
22. Governing law
These terms are governed by the laws of England and Wales.
Consumers living elsewhere in the United Kingdom retain any mandatory rights available under the laws applying where they live.
Any dispute may be brought before the courts with jurisdiction under applicable consumer law.
23. Contacting us
For questions about these terms or an order, please contact Manor Models using the details shown on the Contact page.
